Welcome to Buildkiya. By accessing our platform (buildkiya.com), purchasing digital solutions, ordering custom merchandise, or subscribing to our service plans, you agree to be bound by the following terms and conditions. Please read them carefully before initiating any project.
1Services & Scope of Work
Buildkiya provides full-stack digital services including website development, mobile application engineering, digital marketing, corporate branding, custom packaging, and merchandise printing. The exact deliverables, specifications, milestones, and delivery timelines for every order are detailed in your order confirmation, project proposal, or checkout summary.
2Payments, Pricing & EMI Financing
All prices displayed on Buildkiya are in Indian Rupees (₹) unless explicitly stated otherwise. We offer flexible payment arrangements including milestone billing and 0% No-Cost or low-interest EMI financing:
- One-Time Orders: Payments are processed via authorized PCI-compliant payment gateways. Work initiates once the initial milestone or full upfront payment is verified.
- EMI Tenures: When opting for EMI payment schedules, clients agree to adhere to timely monthly installment debits as configured through their bank or payment provider.
- Taxes: All applicable taxes (including GST) are calculated and itemized during invoice generation.
3Intellectual Property Rights
Client Ownership: Upon receipt of full payment for a custom build or design project, all customized code repositories, proprietary graphics, finalized logos, and brand assets created specifically for the client become the sole intellectual property of the client.
Buildkiya Pre-existing Assets: Any proprietary libraries, reusable frameworks, internal templates, or developer toolkits utilized by Buildkiya remain the property of Buildkiya or their respective open-source license holders.
4Revisions, Delivery & Maintenance
Each product tier includes a defined number of revision cycles and post-delivery support as specified on the product page:
- Web and App products typically include 6 months of complimentary technical maintenance (bug fixes, hosting uptime assistance, and critical security patches).
- Revisions beyond the agreed scope or post-handover feature additions will be quoted as separate work orders.
5Cancellation & Refund Policy
Because our digital services and physical merchandise involve immediate allocation of engineering hours and custom manufacturing materials:
- Custom Software & Design: Cancellations made before project kickoff are eligible for a full refund minus administrative processing fees. Once milestone development has commenced, refunds are prorated based on completed deliverables.
- Physical Printing & Merchandise: Once a proof is approved and dispatched for physical press/printing, customized items cannot be canceled or refunded except in cases of manufacturing defects verified upon delivery.
6Limitation of Liability & Governing Law
In no event shall Buildkiya be liable for indirect, punitive, or consequential damages resulting from third-party hosting downtimes, domain registrar issues, or API disruptions outside of our direct infrastructure control. These Terms are governed by and construed in accordance with the laws of India.
